End User License Agreement

 

The following is a legal software license agreement between you, the software end user, and Cybercom Software.  Carefully read this license agreement before using the product.  Installing and/or using the product indicates that you have read this license agreement and agree to its terms.

 

Grant of License. Cybercom Software grants to you a non-exclusive, non-sublicensable, license to use this software and its components (the "Software"), in binary executable form.  This software is NOT free.  After a once-only 60 day evaluation period you may not continue to use it unless you have a valid license file licensed in your name or in the name of your organization.  In the case of an Individual License, only the specified licensee may use the Software.  In the case of a Company or Site License, the Software may only be used within the named organization.  In both cases the number of users using the software must not exceed the licensed number of users.

 

Copyright. The software contained in this package is owned by Cybercom Software and is protected by Australian copyright laws, international treaty provisions, and all other applicable national laws. The software must be treated like all other copyrighted materials (e.g. books and musical recordings). This license does not allow the software to be rented or leased, and the written materials accompanying the software (if any) may not be copied.

 

Title, ownership rights, and intellectual property rights in and to the Software shall remain the property of Cybercom Software.  You agree to abide by the copyright law and all other applicable laws of Australia, and international copyright laws.  You acknowledge that the Software in source code form remains a confidential trade secret of Cybercom Software and therefore you agree not to modify the Software or attempt to decipher, decompile, disassemble or reverse engineer the Software.

 

Limited Warranty. Cybercom Software warrants that the software contained herein will perform substantially in accordance with the accompanying documentation.

 

No Other Warranties.  Cybercom Software disclaims all other warranties, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose, with respect to the Software, the accompanying written materials, and any accompanying hardware (if any).

 

No Liability for Consequential Damages.  In no event shall Cybercom Software or its suppliers be liable for any damages whatsoever (including but not limited to damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) which results from an inability to use this software, even if Cybercom Software has been advised of the possibility of such damages.  Because some states/jurisdictions do not allow the exclusion or limitation of consequential or incidental damages, the above limitations may not apply to you.

 

LEGAL STUFF

 

The author hereby disclaims all warranties relating to this product, whether express or implied, including without limitation any implied warranties of merchantability or fitness for a particular purpose. The author cannot and will not be liable for any special, incidental, consequential, indirect or similar damages due to loss of data or any other reason, even if the author or an authorized agent has been advised of the possibility of such damages. In no event shall the liability for any damages ever exceed the price paid for the license to use software, regardless of the form and/or extent of the claim. The user of this program bears all risk as to the quality and performance of the software.
